Uh, make sure you have paperwork on that thing...

Hi guys... thanks for the input. My grandfather was over in the pacific in WWII and he brought they type 99 back with him. I've talked w/ another relative and it turns out there is paperwork associated with it, I just need to look at em and verify what's what.

+1 for Jealousy on my part. Keep us updated, this is incredible!

And I think I speak for the Gunnit community when I say, get out and shoot it when you can! Don't make it a safe trophy.

Yeah if there's paperwork associated with it, you've just inherited 5 figures worth of gun. Here is a graphic showing what people have been selling them for:

I'm assuming you are in the United States.
In order to legally own it you first need to determine how your relative owned the gun.
Was it a war trophy (bring back)? If so do you have any documentation showing he registered it?
Does your relative have a Form 1 or Form 4 in the box or with the legal documents of their estate?
Did your relative have a current or expired FFL 01 / SOT license? Do you have the various paperwork for this current/expired license?

If you answered no to all of these questions then you have an illegal machine gun that cannot be registered or transferred.

Please get back us when you find some or any paperwork.

On the Ammo/magazine side, 7.7x58mm Arisaka is pretty damn expensive. Sportsman's guide has it.

The magazines will also be tough, I suggest doing a WTB request on subguns.com

Delete your reddit account and never speak of this on the internet again. If you are lucky no one noticed.

Is it a DEWAT? If not you may need to have it transferred to you on a Form 4. Any other Class III owners out there want to chime in on inheriting a Class III weapon?

It really depends on the paperwork that's with it.

This actually triggered a bit of a legal crisis in my head yesterday. Particularly how do I handle this in my will... I need to talk to a lawyer :)

A trust can also own your Title II items. Only problem is $200 a pop to transfer them in there!

thanks :)

Not the BATF here. Where do you live? We're very interested in finding out. We'd love to meet you.

From this link: http://fingolfen.blogspot.com/2007/04/atf-wants-to-scrap-sgt-yorks-captured.html

“Federal gun laws prohibit possession or sale of automatic guns unless they are registered with the US Bureau of Alcohol, Tobacco, Firearms, and Explosives. In the library attic for years, the German machine gun was never registered. The library isn't allowed to register the gun now because federal law prohibits new registrations on automatic weapons, except in rare circumstances.”

Lotsa luck... hope you have an attorney in the family :-)

I hope the OP replies soon, I'm damned curious about the story on this thing. If it was a bringback but you don't have the papers are you stuck with an illegal gun?

Veteran4Peace 1 point2 points 5 months ago[-]

Just posting here to chime in on how totally jealous I am.

It's very important you find that paperwork, and see exactly what's on it. If you have any questions about the paperwork I suggest you try and call Dan Shea from Small Arms Review, Telephone (702) 565-2926 he is one of the most knowledgeable guys on this. If he can't help you, he can at least point you in the right direction. Good luck and keep us posted :)

Oh, and don't go cleaning it up quite yet.

Feel free to pm/email me with questions as to whether/how you can legally possess this firearm. I am a licensed machine gun dealer and am pretty familiar with the paperwork requirements for them. PM me here or email me at sales@southernmichiganarms.com

Here's to hoping that paperwork is the right stuff you need.
